With the Ripple lawsuit summary judgment approaching, members within the XRP community have heightened their expectations for significant insights. The broader cryptocurrency community and XRP holders are anticipating the Hinman speech documents’ unsealing, which was moved up to June 13. These documents may provide clarification and alleviate regulatory uncertainty.
The Hinman Speech Documents
The Hinman speech documents include email drafts and internal messages concerning a 2018 speech by former SEC director William Hinman. This document has been essential support for Ripple’s defense against the SEC.
The court delayed the unsealing to June 13 following a joint letter requesting a one-week extension by Ripple and the SEC.
Crypto community member Fred Rispoli reacted to the extension, stating that the parties must have already had detailed discussions on these redactions, and he senses a scramble ongoing behind the scenes.
Recently, prominent crypto influencer, Digital Asset Investor, reminded his 330,000 followers via Twitter of the documents’ release, and attorney Deaton of CryptoLaw called attention to the Hinman speech’s fifth anniversary on June 14, 2018.
Notably, on June 14, 2018, William Hinman declared that Ethereum is not a security. Deaton and others will discuss the documents on the same date in 2023.
Implications of Hinman Emails
Pro-XRP lawyer John Deaton believes that public access to the documents will help clear up confusion and speculation surrounding the speech drafts. Deaton speculated that the emails could highlight Hinman’s conflicts of interest and reveal the difficulty of applying outdated precedents to modern technology. However, he added that these documents would not change the Howey test.
Deaton also mentioned that the documents could help Coinbase and Ripple in the court of public opinion and potentially influence bipartisan efforts in Congress.
